
According to a press release from an Independence, Missouri law firm, Humphrey, Farrington & McClain, they are partnering with Clinton, Missouri attorneys and are representing residents facing illness, property damage and future medical claims caused by the troubling contamination of soil, air and ground water by the Evergy power plant facility near Montrose, Missouri.
The press release stated:
Senior partner and lead trial counsel Ken McClain said, “the conduct resulting in this contamination was clearly negligent and probably reckless. The contaminants and toxins found near these Henry Country residents’ homes, farms and schools are known hazards and, in many instances, cause cancer and other deadly illness. This problem was predictable and should never have happened.”
Humphrey, Farrington & McClain (HFM) is a locally based firm that has handled environmental and toxic tort claims around the country for decades, including Henry County. For example, in 2017 a trial court judge awarded more than Eleven Million Dollars ($11,000,000) to a worker who developed respiratory illness while working at the Montrose coal-fired power plant, including Five Million Dollars ($5,000,000) in punitive damages.
HFM has also successfully represented communities impacted by water contamination in Joplin, Missouri, for both injunctive relief and personal injuries and death. In some instances, HFM forced defendant to pay for safe drinking water for residents whose water was contaminated.
